How to sue a seller for fake product on online shopping sites?

I recently bought a music player from Aliexpress which too more than three weeks for the product to be delivered to my local post office where i went to pick it up after paying for shipping charge I also paid the post office personnel some cash after I got the product. On getting home I found out the product wasn't charging even while it indicate that it is charging and that it can play sound from my phone when connected to Bluetooth.

Have contacted Ali express and the seller but they refuse to give me a refund or accept the goods back, how do I get justice for a fake product that I received ?

Did you pay for the item with a credit card? I used to work for a bank and you should be able to fill in what’s typically called a Disputed Transaction Form. Some banks may call it something slightly different.

Essentially there’s a provision on that form to say that you didn’t get goods that were as the merchant described. Check with your financial institution if you paid with card and they should be able to help you out with trying to get your money back.

I paid with a debit card and I opened dispute against the seller but after giving them evidence, Ali express delivered a judgement in my favor but up till now have not received any refund.

Since they have given a verdict in your favor, then there is nothing that you've got to worry about. One important thing that I always know is that the seller is definitely going to comply unless he/she doesn't want to be selling things on Ali express. Just try to remind Aliexpress about it on some days and hope they give some deadline to the seller.

Even if you are buying from the third party seller, you will never be cheated on Amazon because all the third party products available in Amazon are fulfilled by Amazon. If you buy on ebay, you can be scammed, however, ebay accepts paypal payment and you can file a dispute if you are scammed. You can get full refund. If you are buying on other websites, always pay via paypal. Paypal provides buyer protection, which means it will always favor the buyer.

Thanks you very much on this, I will learn to make my transactions via PayPal to avoid stories that touch, just like the one am experiencing presently. But I will to know if I will be charged for the transaction if I pay through PayPal?

What I know from the experiences of others who bought something on aliexpress, there's no way you'll get a refund. As it has been suggested, the best way to get your money back if you paid via credit card is by requesting a charge back. Whether that request will be honored is an entirely different matter.

As for suing, it might cost you a lot more than you have already lost.

Requesting a chargeback is the best action one can take in a case where refunds cannot be made. I have done that severally, even in writing sites that charge and fail to refund when the service is not offered.

Well that's China your ordering from, what can you exoect? They became a world power by producing and selling cheap knockoffs to the whole world. I've also bought products in AliExpress and because of the rock bottom prices it's s hit and miss kind of deal. The only thing you can do now is to dispute it but it really takes a long time and most of the time you won't get your money back. It's always best to buy straight from the legit manufacturer so that warranties are in placed.

From what I have read on this content, you said that the company have ruled in your favor but they are still yet to refund your money back. I would like to know how long it's been that you have been waiting for your money? Since the company is at fault here, there shouldn't be much issues with refunding your money back.

Its been more than one week now without the fund and have contacted their customer service, they told me to wait for some few days and have been waiting since then but i hope that they attend to me soon because am not ready to let them have my hard earn money.

Yea, I just got the refund yesterday night from Ali express to my bank and am so happy that my money was refunded back to me but the state o the product is too bad that i don't know what to do with it currently rather than just keep in my house as a decoration, but i will just take this ones as a mistake and give Ali express another chance.

While it is good that finally did get a refund, there are no guarantees that next time you buy a defective product you'll get your money back. What if it is a fly-by-night seller who sells you the product?

When you have one bad experience at a store it is better to do your shopping elsewhere.

Report a complaint on this regard along with your preferred portal and you'll be greatly surprised to see them shunning their obligation by genuinely quoting that they're not responsible for the goods or services listed at the website as they're simplest a marketplace, and that the obligation for this type of lapse lies with the manufacturer or dealer. I think there has to be process for this. I have seen amazon and eBay being serious about this. They close the account of the seller instantly. So that can be one good option. In some safe cases you can also send the refunds and cancellation. So to some extent that may work out. And another thing is that online shopping sites like this earns good commission on sales so they do take this seriously.

This is a good caveat (warning) to online buyers because we had experienced returning a product that we bought. It was garden hose that lacked a part. We returned it via the courier of the store for free and the product came back after 2 weeks. It was good to know that the store is true to its word of replacing the defective product or refunding it. But with your experience with Ali Express I don't think I will click on that link.
